Finsight — End User License Agreement

This End User License Agreement (“Agreement”) is between Element Accounting (“we,” “us,” or “our”) and the user (“you”) of the Finsight financial analysis application (“Application”).

1. License Grant

Element Accounting grants you a limited, non-exclusive, non-transferable license to use the Finsight application solely for your internal business purposes in connection with your accounting and financial management activities.

2. QuickBooks Online Integration

Finsight connects to Intuit QuickBooks Online (“QBO”) on your behalf to retrieve financial data for the purpose of generating financial analysis reports. By using this application, you authorize Element Accounting to access your QBO data through Intuit’s authorized API in accordance with Intuit’s developer terms.

3. Data Use

Financial data retrieved from QuickBooks Online is used solely to generate financial reports and analysis for you. We do not sell, share, or distribute your financial data to any third parties. Data is processed securely and stored only as necessary to provide the service.

4. Restrictions

You may not copy, modify, distribute, sell, or lease any part of the Application. You may not reverse engineer or attempt to extract the source code of the Application.

5. Disclaimer of Warranties

The Application is provided “as is” without warranty of any kind. Financial reports generated by Finsight are for informational purposes only and do not constitute professional financial, legal, or tax advice. Always consult a qualified professional before making financial decisions.

6. Limitation of Liability

Element Accounting shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Application or reliance on any financial analysis it produces.

7. Termination

This license is effective until terminated. Your rights under this Agreement terminate automatically if you fail to comply with any of its terms.

8. Governing Law

This Agreement is governed by the laws of the Province of Alberta, Canada.
